Distributor Terms, Agreements, & Policy
Content Policy for Distributors
The term "company" shall refer to Pro Distributor LLC partner, affiliate, trademarks, it's, parent or subordinate companies, executives, owners, sponsors, or any entity deemed company through interpretation by Pro Distributor LLC.
The term media in this documentation shall refer to any form of video, audio, images, thumbnails, picture, drawings, and the transmittal, posting, displaying, sharing, or public use of such, used in conjunction with, stored, displayed through Distributor website, subdomain, server, or linked websites, and determines whether Distributor is in violation of Content Rules and in Breach.
Company determination of violation will not exclude undeveloped, or unlicensed forms of new, alternative, pending patent means of communication, data, sharing, and use of such by electronic, or wireless transmission.
Trademark: The trademarks of the National Football League and the National Collegiate Athletic Association may not be used by any means within Distributor website. Pictorials, such as helmets, or products bearing logos of teams may be displayed, but stand alone pictures of the NFL, NCAA, Super Bowl, logos may not be displayed without permission of such by said owners of trademarks.
We reserve the right to suspend accounts or take other appropriate action when someone’s brand or trademark, including business name and/or logo, is used in a manner that may mislead or confuse others about your brand affiliation.
Copyright: Pro Distributor LLC. may take action on behalf of a company, organization, or person whose copyright is being violated, without warning to Distributor, if Distributor is deemed to be in violation. Notices of alleged copyright infringement will be sent to Distributor upon such violation.
Graphic violence in any form of media which depicts persons, animals, or any creature which has blood is forbidden, including the following:
- displaying of death, or deceased people or animals,
- violence, such as stabbing, shootings, or any trauma that results in the display of blood or gore,
- surgical procedures, internal organs, or any medical procedure regardless of educational purpose
- violent motor vehicle crashes or high speed crashes
Distributor may display media from athletes, or professionals who have internal injuries, such as a broken arm or leg, as long as those injuries are not bleeding, or open wound injuries.
Examples of Allowed Content:
- Media of a snowboarder falling and breaking a body part but is fully clothed with no internal damage displayed through the clothing.
- Media of a football player who is injured, with no internal damage displayed, and carted off the field.
- Media of a Mixed Martial Arts fighter whose leg, arm, or ankle is broken, with no internal damage displayed.
Examples of Disallowed Content:
- Any vehicular motion hitting pedestrians.
- Vehicular crashes that result in death or gore.
- Active shooter content whether fictional or non-fiction.
- Athletes injured with blood or bones displayed, whether in still picture format or video format.
Adult Content
There is zero-tolerance on pornographic, nude, and sexual content. Adult content, nude, flashing of nudity, no matter if considered artwork, promotion of children in any way sexual, whether clothed or unclothed, by video streaming, or any picture(s) is forbidden. Sale, and distribution of any type of sexual devices, including creams, lubricants, and media, or the promotion of, through Distributor website by linking, sharing, or embedding to Adult Content is forbidden. Accounts will be terminated without warning upon such causing Distributor to enter into Breach.
Hate Speech through Media
Although Distributor has the right of free speech, the products being sold by Distributor may have licensing that determines how communication is regulated in the sale of such products, by corporate non-discrimination policy as adapted, or that may be updated or changed from time to time. As such, Distributor, regardless of personal, affiliated, or representation of political party belief, agrees that freedom of speech does not allow Distributor to violate the policies and principals of company and may not do the following.
Content creators using blogs, podcast, game console, non-audio depiction, or any form of public speech/communication platform through Distributor website, may not promote or cause violence through threats, or harassment to people of any racial difference, ethnicity, sexual orientation, gender identity, religious affiliation, age, disability, or disease.
Examples:
A login user name, or avatar depicting a publicly known slander, or racial degradation against any ethnic group (any group of people).
A podcast discussing inferior differences in classes of people, or joking of such through comedic methods.
Any perceived, illicit, or notification of such by public, or executive personnel may render Distributor in violation and Distributor should have on file a non-discrimination policy.
Malware, Phishing, Spam
Distributor may not use website to upload purchased email lists for the sole purpose of soliciting the public for sales. Distributor must follow Federal CAN-SPAM Act (click to go to site) rules and regulations. As noted in the act:
Q. How do I know if the CAN-SPAM Act covers email my business is sending?
A. What matters is the “primary purpose” of the message. To determine the primary purpose, remember that an email can contain three different types of information:
- Commercial content – which advertises or promotes a commercial product or service, including content on a website operated for a commercial purpose;
- Transactional or relationship content – which facilitates an already agreed-upon transaction or updates a customer about an ongoing transaction; and
- Other content – which is neither commercial nor transactional or relationship.
Emails must be legitimately acquired by customers visiting Distributor website and choosing to give their email freely without false premise coercion. Email targeting campaign's performed by third party services such as, MailChimp, SendInBlue, ConstantContact (email agency may request inclusion here) may be used in conjunction with company content rules.
Distributor website and employees may not create links to malicious content intended to damage, hack, cause release of a trojan, or malware, perform spoofing attacks, web spidering, or any harmful bots, CPA software, fake game generators, mislead with iframing submission boxes for the sole purpose of stealing content information, emails, user data, credit cards, or any coding; nor disrupt browsers or create pop-ups to gather emails for the purpose of harvesting and spamming.
